Terms of Service

1. Acceptance of Terms

By accessing or using the PickLM platform ("Service"), including our website, mobile application, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

PickLM is a pickleball club management platform that provides tools for club owners, managers, and players to manage memberships, organize leagues and tournaments, track scores and standings, communicate with members, and manage court reservations.

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4. User Conduct

ZERO-TOLERANCE POLICY

PickLM maintains a strict zero-tolerance policy for objectionable content and abusive behavior. This includes but is not limited to:

Harassment, bullying, intimidation, or abuse of other users
Hate speech, discriminatory language, or content targeting any group
Sexually explicit, obscene, or pornographic content
Violent threats, dangerous behavior, or content promoting self-harm
Spam, scams, fraud, or deceptive content
Content that violates any applicable law or infringes on others' rights

Violations will result in immediate account suspension or permanent termination without prior notice. PickLM reserves the right to remove objectionable content at its sole discretion and report serious violations to law enforcement authorities.

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Submit false, misleading, or fraudulent information
Harass, abuse, or harm other users
Interfere with or disrupt the Service or its infrastructure
Attempt to gain unauthorized access to any part of the Service
Use the Service for any commercial purpose not expressly permitted

4.1 User Blocking

You may block other users at any time. Blocking a user will:

Remove their content from your feed and messages
Prevent them from contacting you
Notify PickLM for review of the blocked user's conduct

PickLM reviews all block and report actions to maintain community safety.

5. Club Management

Club owners and administrators are responsible for managing their clubs in compliance with these Terms. This includes ensuring that club activities, leagues, and tournaments are conducted fairly and in accordance with applicable laws. PickLM provides the tools for management but is not responsible for the operation or conduct of individual clubs.

6. Leagues and Tournaments

The Service allows users to participate in leagues and tournaments organized through the platform. By joining a league or tournament, you agree to abide by the rules set by the organizer. PickLM is not responsible for disputes between players or between players and organizers. Score submissions and standings are managed through the platform but the accuracy of results depends on participant input.

7. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by PickLM and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

8. User Content

You retain ownership of content you submit through the Service (such as profile information, messages, and scores). By submitting content, you grant PickLM a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content as necessary to provide the Service. You are solely responsible for the content you submit and must ensure it does not violate any third-party rights.

9. Third-Party Authentication

The Service supports sign-in through third-party providers such as Google and Apple. By using these sign-in methods, you also agree to the respective provider's terms and conditions. PickLM is not responsible for the practices of third-party authentication providers.

10. Account Deletion

You may delete your account at any time through the Settings screen in the app. Upon deletion, your personal data will be permanently removed from our systems, including your profile, game history, statistics, and league memberships. This action cannot be undone. Some anonymized, aggregated data may be retained for analytical purposes.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. PickLM does not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of any data, scores, or standings displayed through the Service.

12. Limitation of Liability

To the maximum extent permitted by law, PickLM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to PickLM in the twelve months preceding the claim.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall remain in effect.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
